Federal judge strikes down California's ban on same-sex marriage

...in a 136-page ruling, Walker sided with two same-sex couples who challenged voter-approved Proposition 8, which embedded a ban on gay marriage in the California constitution and wiped out a prior California Supreme Court ruling that briefly legalized same-sex nuptials across the state. Walker ordered that Proposition 8 should be immediately voided, and same-sex couples be given the chance to marry across California.

"Proposition 8 fails to advance any rational basis in singling out gay men and lesbians for denial of marriage licenses," the judge wrote. "Moral disapproval alone is an improper basis on which to deny rights to gay men and lesbians. The evidence shows conclusively that Proposition 8 enacts, without reason, a private moral view that same-sex couples are inferior to opposite sex couples."

Sanity and justice finally prevail against bigotry and fear-mongering, my joy over this mingled with the sweet, sweet taste of fundie/wingnut rage-induced tears has made today just about perfect.

UPDATE: And so it begins... collect those sweet wingnut tears while they're fresh and hot from the source. Rage-on, wingnuts, rage-on!

As I commented in another friend's journal on this subject: I still wish that I lived in a state where the majority of _voters_ made rational decisions, but it makes me feel better to know that we still have judges willing to make sane judgements in the face of the tyranny of the majority. Now I hope this gets upheld all the way to the Supreme Court.

Amen to that, particularly when it comes to the voting issue, I still can't believe people were actually swayed by scare tactics like that absurd "a storm is coming" commercial. And yet...
