Many big sloppy kisses to
elo_sf for bequeathing his mondo 27" tv upon me, and for lugging it down the stairs at his place. That thing's a real monster! And big hugs to
tersa for helping me lug it into my place. Definitely one of those times I was incredibly glad to live on the first floor. It just barely fits on my tv stand, for a second or two I wondered if I shouldn't have measured it first. But we got it on there. And I've already had someone express interest in my old one on Freecycle so it shouldn't be cluttering up my living room for much longer either. Yay!
eilonwey's baby shower was lovely on Saturday, though it reminded me once again that I both suck and blow at shower games. I mean really, I'm just awful. Went home afterwards and watched the BSG ep we'd missed by going to see Nightwatch Friday night. While I'm thinking of it, Santana Row is fucking insane to try to park at on a Friday evening. Seriously, nutty, just nutty. The theater was nice, though, and the seats were definitely more comfy than the Aquarius. Everybody else seemed to enjoy it as much as I did, which makes me happy.
Anyway, Saturday we grabbed some dinner and then settled in for a truly atrocious Chinese "horror" film called "Death Melody". It looked like it had been a made for public access production. And the subtitling was quite possibly the worst I'd ever seen, which of course made it wildly amusing for all the wrong reasons. After that we watched the Japanese horror film "The Audition". I liked the build up in the movie, the establishment of the characters and their motivations that lulled you into thinking you were going to get a sort of mild comedy/romance. And then, of course, the last 15 minutes changed all that in an incredibly gory manner. The best part, though, was Aelf's reactions to the various scary bits, I had to bite my tongue several times so as not to give away what was coming next. I can safely say she didn't disappoint on that one :)

SUIT ANNOUNCED:
In The News (freecycle) Being Sued!
To protect all members we update what is going on in
the world of giving and getting items for free. As
part of the free ONTARIO reuse GROUPS we take it very
seriously when many of the members are a part of a
network (freecycle) that is having much trouble and
want to forewarn those who might be harmed in any way.
At present freecycle is in a court battle and being
sued by FreecycleSunnyvale for damages incurred by
freecycle falsely claiming trademark infringement
toYahoo. In Deron Beal's (freecycle owner) own words
on this page you will see that this could be the end
of freecycle should FreecycleSunnyvale win the
lawsuit. You can read the legal filing here in Adobe
format
http://freesharing.org/gr/files/2006-01-18_FreecycleComplaint.pdf
Further at present freecycles trademark applications
have been extended. But it does not look good for
freecycle as the evidence has been collected in this
case against freecycle. Just read the .pdf above.
We hope that all in this group who freecycle stay
safe. free ONTARIO reuse GROUPS are in no way
affiliated with freecycle. Have a great day and
remember to always bring a smile :)

Subject: Important: freecycle trademark opposition &
lawsuit
Content-Type: text/plain; charset="us-ascii"
Hi folks,
As you probably remember, The Freecycle Network (TFN)
took issue with Sunnyvale's great freecycling group.
Below are some consequences that TFN now faces.
FreecycleSunnyvale continues to believe that it is
best for freecycle to be free for everyone. The
freecycle grassroots movement should stay true to its
own freecycling philosophy.
1) On 1/17/2006, The Freecycle Network's (TFN's)
proposed trademark registration was published for
opposition in the Trademark Official Gazette at:
http://www.uspto.gov/web/trademarks/tmog/
2) On 1/18/2006, the unincorporated non-profit
association FreecycleSunnyvale filed a formal
opposition to TFN's trademark registration with the
USPTO. You can read it at:
http://ttabvue.uspto.gov/ttabvue/ttabvue-91168664-OPP-1.pdf
3) On 1/19/2006, FreecycleSunnyvale also filed a
lawsuit against The Freecycle Network in federal court
(US District Court, Northern California). We will
point you to a copy of this filing as soon as we can.
4) Mayer, Brown, Rowe & Maw LLP (one of the 10 largest
law firms in the world) are the attorneys for
FreecycleSunnyvale and are providing their services
pro bono. None of the members of FreecycleSunnyvale
(which includes Tim Oey) are spending any of their own
money for the opposition or the lawsuit. You can read
more about the law firm at:
http://www.mayerbrownrowe.com/overview/index.asp
and
http://www.ipcounsel.com/
5) Anyone else who wishes may now file an opposition
to TFN's proposed trademark registration (please note
that there is a fee to file such an opposition). If
you or your group has been harmed by TFN, you may also
file a lawsuit of your own against TFN.
6) Since a lawsuit and an opposition are now underway,
the members of FreecycleSunnyvale may be restricted in
what they say.
7) If TFN chooses to negotiate, these cases could be
settled in a few months. If not, they may take many
months.
Sincerely,
Tim Oey on behalf of FreecycleSunnyvale
